Terms of service
These terms apply when you use byevie.com or purchase from By Evie. Please read them together with our Returns and Refunds Policy, Shipping Policy and Privacy Policy.
1. About By Evie
By Evie offers clothing made with petite mums in mind. Our store is hosted by Shopify, which provides the ecommerce platform we use to sell our products. For questions about these terms or your order, email hi@byevie.com.
2. Using our website
Please provide accurate contact, billing and delivery details and keep any account login details secure. You must not use our website for unlawful purposes, attempt to gain unauthorised access, interfere with its operation or submit fraudulent orders.
3. Product information and sizing
We aim to describe and photograph our products accurately. Colours may appear differently depending on your screen and lighting. Please read the product description and size guide before ordering, and contact us if you need help choosing a size.
Any measurement tolerances will be stated in the relevant size guide. These notes do not limit your rights if a product is faulty or materially different from its description.
4. Prices and payment
Prices are shown in Australian dollars. The total payable, including applicable taxes and shipping charges, is shown at checkout before you place your order. Payment options available for your purchase are displayed at checkout.
Prices may change for future purchases. A later price change does not change the agreed price of an existing order.
5. Orders and availability
After you place an order, you will receive an order acknowledgement. If there is a payment issue, an error in the listing or insufficient stock, we will contact you to explain the issue and discuss the next steps.
If we cannot supply an item you have paid for, we will offer an available alternative for you to accept or a full refund for the unavailable item. We will not substitute an item without your agreement. If we cannot fulfil any part of your order, we will refund the order payment, including shipping.
6. Cancellations and order changes
If you need to cancel an order or change a size, colour or delivery address, email hi@byevie.com as soon as possible with your order number. We will check whether your request can be accommodated before the order is dispatched and confirm the outcome.
Once an order has been dispatched, changes may no longer be possible. Our returns policy explains the options available after delivery. This does not limit any cancellation or refund rights you have under Australian Consumer Law.
7. Shipping and delivery
Our shipping rates, delivery areas, dispatch times and estimated delivery times are set out in our Shipping Policy. Please check your delivery address before ordering.
Delivery estimates are estimates rather than guaranteed arrival dates. If your parcel is delayed, missing or damaged, contact us so we can help investigate and provide any remedy required by law.
8. Returns, exchanges and refunds
Our Returns and Refunds Policy explains eligibility and the process for change-of-mind exchanges and store credit, as well as remedies for faulty products. Change-of-mind conditions do not restrict your statutory consumer rights.
9. Discounts and promotions
Discount codes must be entered at checkout. Unless an offer states otherwise, codes can be used once per customer and cannot be exchanged for cash. Any offer-specific eligibility conditions, exclusions and expiry dates will be provided with that offer. Please check those terms before ordering.
10. Store credit
Store credit issued under our returns policy can be used towards a future By Evie order. Any redemption conditions will be provided when the credit is issued. Store credit will not replace a refund you are entitled to under Australian Consumer Law unless you choose to accept it.
11. Website content and external links
Our branding, photographs and other original website content are protected by applicable intellectual property laws. Please obtain permission before using our content commercially, unless the law permits that use.
External websites have their own terms and privacy practices. Please review them before using those services.
12. Privacy
Our Privacy Policy explains how personal information is handled when you visit our website, place an order or contact us. For privacy enquiries, email hi@byevie.com.
13. Australian Consumer Law
Our products come with consumer guarantees that cannot be excluded under Australian Consumer Law. Nothing in these terms or our other policies excludes, restricts or modifies those guarantees or any other rights that cannot lawfully be excluded.
14. Changes to these terms
We may update these terms for future website use and purchases. The terms in effect when you place your order apply to that order. Later updates do not retrospectively reduce your rights.
15. Governing law and contact
